Acceptance of Terms

By browsing this site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site. These terms apply alongside our Shipping Policy, Return & Refund Policy, Payment Policy and Privacy Policy, all of which are linked in the footer.

Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm you meet that requirement and that the payment method you use is yours or that you have permission to use it.

Products & Pricing

Prices are shown in US dollars and can change without notice. Product availability can change at any time. We take care with the prices and details we publish, but errors happen. If an item is listed at an incorrect price, we will contact you before processing the order and give you the choice of paying the correct price or cancelling for a full refund. We do not have to fulfil an order placed at an incorrect price.

Order Acceptance

Placing an order is an offer to buy, not a completed contract. We accept your offer when we email you to confirm the order has been dispatched. Until that point we can decline or cancel an order, including where an item is out of stock, where a payment cannot be authorised, or where a verification check does not clear. Anything already taken is refunded in full.

Intellectual Property

The text, images, layout and branding on this site belong to Baby Blue Fashion. You may not copy, reproduce or republish them for commercial use without our written permission. You are welcome to share a link to a page or to save an image for your own personal reference.

User Conduct

Do not use this site to commit fraud, to attempt unauthorised access to any part of it, to interfere with its operation, or to extract data from it by automated means. Do not place orders using a payment method you are not entitled to use. We may refuse service, cancel orders and restrict access where we believe any of this is happening.

Limitation of Liability

We are responsible for supplying the goods you ordered, and for refunding or replacing them where our policies say so. We are not responsible for losses beyond that which we could not reasonably have foreseen, such as loss of income or missed occasions arising from a delayed delivery. Nothing here limits our liability for death or personal injury caused by our negligence, or for fraud, because the law does not permit that to be limited.

Termination

We may suspend or end your access to the site where these terms have been breached, where we believe fraud is involved, or where continued access presents a risk to the site or to other customers. Any order already dispatched is unaffected, and any order paid for but not dispatched is refunded.

Changes to Terms

We update these terms as the business changes. The current version is always on this page, with the date it was last updated. The terms that apply to an order are the ones published at the time the order was placed.

Governing Law

These terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.

Disclaimer of Warranties

The site and its content are provided as is. Beyond the warranties implied by law that cannot be excluded, we make no further warranty that the site will be uninterrupted or error free, or that any product will meet a purpose you have in mind but have not told us about. Your statutory rights as a consumer are unaffected by this section.

Indemnification

You agree to hold Baby Blue Fashion harmless from claims, losses and reasonable legal costs arising from your misuse of the site, your breach of these terms, or your infringement of someone else's rights through your use of the site. This does not apply to anything arising from our own acts or omissions.

Dispute Resolution

If something goes wrong, email support@babybluefashion.com first. Most problems are solved directly and quickly, and we would rather resolve a complaint than argue about it. If we cannot reach a resolution, either of us may pursue the matter through the courts of the State of New York. We do not require you to give up your right to go to court, and we do not require arbitration.

Governing State Law

These terms and any dispute arising from them are governed by the laws of the State of New York. The courts of the State of New York have jurisdiction.
